By accessing or using PhilDesk ("the Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
PhilDesk provides AI-powered customer support automation for Shopify merchants, including an AI email agent, a live chat widget, order-aware automation, and analytics. Features and usage limits vary by plan.
3. User Accounts
You're responsible for maintaining the security of your account and password, and for all activity that happens under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
4. Subscription & Billing
Paid plans are billed in advance on a recurring basis (typically monthly) through our payment processor. You can upgrade, downgrade or cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose, to interfere with its operation, or to transmit malicious code. We may suspend accounts that abuse the AI agent, violate Shopify's or our partners' terms, or put other users at risk.
6. Intellectual Property
PhilDesk and its original content, features and functionality are owned by us and protected by applicable intellectual property laws. You retain ownership of your store data and customer content; you grant us a limited license to process it solely to provide the Service to you.
7. Limitation of Liability
To the maximum extent permitted by law, PhilDesk is not liable for indirect, incidental, special, consequential or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Service.
8. Termination
You may stop using the Service and close your account at any time from your dashboard. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.
9. Governing Law
These Terms are governed by the laws of the jurisdiction in which PhilDesk operates, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date; continued use of the Service after changes take effect constitutes acceptance.
